IntroductionTeam A conducted research on FastServe Inc. regarding legal issues related to the company's workforce reduction. This paper will address issues important to understanding and avoiding the risks of discrimination claims against FastServe Corporation by: 1) discussing what role seniority plays in making decisions to reduce the workforce, 2) examining the extent to which management should consider gender, race, age, and other protected class designations when making force reduction decisions, 3) explain the role ethics plays in the decision-making process, and 4) recommend employment policies for FastServe Inc. Under Title VII of the Civil Rights Act of 1964 Employment practices must comply with federal and state antidiscrimination legislation (Harshman & Rudin, 2000). Legal Issues in Workforce Reduction After receiving the layoff notice and redesigning the employee job descriptions, specific areas were reviewed in order to make a decision that would provide the best outcome for the company. These areas included job performance, productivity, special accomplishments, job responsibility, educational qualifications, absenteeism, and status. Length of service should play a role in making headcount reduction decisions in a non-union organization, but should be taken into account along with skill level. An employee should not keep their job simply because they have been with the organization for several years. Every employee should be evaluated not only on how long they have been with the organization, but also on their performance.
