The world's first extradition agreement was made in the year 1259 BC by Ramesses II of Egypt and the Hittites. The agreement obliged both Ramesses and the Hittites to send back criminals and political figures who attempted to flee to the other side. Since then, extraditions have become bilateral agreements between nations for the transfer of criminals from one nation to another. Extradition is requested when an individual commits a crime within the country requiring extradition. The extradition request includes: the description of the person, information about the case and the laws relevant to the case. Each country must agree to extradite each other for the trial to take place. Canada only has fifty-one Canadian treaties with other countries. This paper will argue that extradition laws in Canada are too slow due to Section 7 of the Charter of Rights and Freedoms and the need to seek guarantees that the death penalty will not be used. Section 7 of the Charter of Rights and Freedoms states that every person has the "right to life, liberty and security of person and the right not to be deprived thereof except in accordance with the principles of fundamental justice", so it is often used as a deterrent so that individuals should not be extradited to another In the following case, United States v.
