One of the case law is Velevski v R [2002]. Other case law referred to by the court are Whitehorn v The Queen (1983) and R v Basha (1989). Whitehorn v The Queen sets out the procedures the Crown must follow to ensure a fair trial for the accused (Haoui v Regina, 2008). The case law of R v Basha provided guidelines which the court had to use to admit late expert evidence. The court of appeal also made use of parliamentary laws to rule on the admissibility of the expert reports. The statute relied upon is the Evidence Act 1995. This statute has guided the court on how to deal with expert evidence that causes bias. The sections used are 136 and 137.
