In the case of Michael T. Vandall, MD, plaintiff and appellant against Trinity Hospitals, a corporation, and Margaret C. Nordell, MD, the issue concerns retaliatory resignation. Vandall was hired in 1996 by Trinity Hospital under the Physician Services Agreement. The Physicians Services Act, or PSA, is a contract that establishes terms of engagement, such as liability, scheduling, compensation and insurance. PSAs are a form of alignment between hospitals and physicians that falls just short of full employment. The hospital contracts physicians for certain defined professional services, and the hospital directly employs the group's staff and bears administrative costs (Herman, 2012). While working at the hospital's obstetrics and gynecology department, Dr. Vandall, as deputy chair of the obstetrics and gynecology department, learned that another hospital employee, Dr. Margaret Nordell, was engaged in a level of treatment that was unethical and violated accepted standards of care. It was his duty to the hospital and patients to monitor the competence of his staff members. Although she tried to take appropriate steps to address it within the hospital, she ended up reporting it to the North Dakota Board of Medical Examiners. The Board concluded that Dr. Nordell's treatment had been grossly negligent and they suspended her license to practice medicine. Vandall did what the law required him to do when he learned what was happening. Subsequently, Dr. Nordell began to file numerous complaints against Dr. Vandall, stating that he was "looking at his patient's concern...halfway through the document...for patients. There was no danger of in his life, none person was threatened in front of him or property was destroyed, as happened in the staged films, but I'm sure he was aware of the legal action that would occur anyway Dr. Vandall has fulfilled his ethical duties denouncing Dr. Nordell's actions and scrupulously respecting his rights to protect himself when dealing with the hospital.
