Initially, Thomas fired Baker for failing to show up daily while on medical leave. Lindsey stated reasons such as “Baker encouraged other employees to resign, disobeyed his orders by leaving the center to run errands during the day, and generally behaved inconsistently” (Baker v. Silver Oak, 2013). Upshaw simply stated that Baker was fired for “multiple reasons” (Baker v. Silver Oak, 2013). The last issue I found offensive is harassment during medical leave. Baker took an approved medical leave for several weeks. I didn't understand why Thomas felt it necessary to have Baker come every day. Under the FMLA, Silver Oak could not use Baker's approved medical leave as a reason for termination (Findlaw, n.d.). Additionally, if it were approved, Thomas and HR would know the length of the leave, so daily calls would not be necessary. In the Baker v. Silver Oak case, this company really wanted to clean out its employee pool and replace them with younger employees. I find it shameful that Thomas has gone to extremes to try to weed out older employees. We do not know the ages of Thomas and Lindsey, however, they are both growing older every day and will eventually have to leave Silver Oak
