By constitutional design, the Public Protector's conclusions must have consequences, for his conclusions to have no consequences or be ineffective would mean that the powers of the offices are useless in strengthening our constitutional democracy. The president's action judged in a court of law is an exercise in constitutional interpretation. Article 172 of the Constitution guarantees that the Constitutional Court has exclusive jurisdiction to decide whether the President fails to fulfill his constitutional obligations should not be surprising, considering the extent and vital importance of his responsibilities. Mogoeng CJ, concluded that the EFF made a case that the President's alleged failure to comply with remedial action, together with the failure to comply with the Constitution, relate to constitutional obligations imposed specifically on him which are intimately connected to the matter central to this question, namely the obligation for the President to comply with the remedial action. The conditions for the exercise of the exclusive jurisdiction of this Court are met. Source
